RELATING TO HOUSING (CONVEYANCE TAX)

Restructures the conveyance tax to a marginal rate system for the sale of properties with residential use, adjusts the tax for multifamily properties to reflect value on a per-unit basis, and applies a cost-of-living adjustment to conveyance tax rates. Allocates revenues from conveyance tax collections. Allocates a portion of conveyance tax collections to the Dwelling Unit Revolving Fund to fund infrastructure programs in county-designated transit-oriented development areas that meet minimum standards of transit-supportive density. Allocates a portion of conveyance tax revenues to the Hawaiian Home Lands Trust Fund.

RELATING TO AGRICULTURE

For taxable years beginning 1/1/2027, amends the Important Agricultural Land Qualified Agricultural Cost Tax Credit to: (1) include Hawaiian home lands designated for subsistence agriculture, supplemental agriculture, or pastoral in the definition of “important agricultural lands”; and (2) expand the definition of “qualified agricultural costs” to include costs relating to the planting of orchard or fruit-bearing crops, or expenditures related to the clearing of former sugar and pineapple plantation lands.

RELATING TO NATURAL RESOURCES

Authorizes geological subsurface characterization activities conducted by a public research institution under certain conditions. Clarifies that boreholes or test holes drilled for the purposes of geological subsurface characterization are distinct from water well exploration and geothermal or mineral exploration. Requires the Department of Business, Economic Development, and Tourism, to designate the Hawaiʻi Groundwater and Geothermal Resources Center of the University of Hawaiʻi, or a successor entity, as the repository for data collected from any geological subsurface characterization activity. Requires the Department of Hawaiian Home Lands to designate a repository or be the repository for any scientific data collected from any geological subsurface characterization activity on lands it holds in trust. Requires the Department of Land and Natural Resources to amend its exemption list to specify that certain geological subsurface characterization activities shall be exempt from the environmental review process or shall only require an exemption notice. Requires the University of Hawaiʻi to amend its exemption list to specify that certain geological subsurface characterization activities shall be exempt from the environmental review process or shall only require an exemption notice. Requires the Department of Health to amend its rules related to hazardous waste and hazardous waste management for consistency with federal regulations to specify that certain waste products generated by geological subsurface characterization activity are exempt from hazardous waste management requirements. Requires that the first site where a borehole or test hole is drilled shall be on lands owned by DHHL. Establishes the Hawaiʻi Groundwater and Geothermal Resources Center within the School of Ocean and Earth Science and Technology of UH Manoa. Appropriates funds.

Proposal Guidelines

Proposals must be good public policy; address the department’s operations, programs, regulations, processes, budget and/or resources; and create a benefit or an advantage for the department, the trust, or trust beneficiaries, or otherwise correct a deficiency. Authors of proposals should keep in mind that amendments to the Hawaiian Homes Commission Act, 1920, require review by the U.S. Department of the Interior and may require the consent of the U.S. Congress prior to implementation.

Review and Consideration

Staff will review and evaluate all proposals and will determine which will be submitted for consideration for the Governor’s Administrative Package. The proposals to be submitted to the Governor will be approved by the Hawaiian Homes Commission. Proposals not submitted to the Governor may be introduced independent of the administrative package. Please note that the Governor may also choose not to include proposals submitted by the Commission.

Legislative Timeline

  1. June 16, 2025

    DHHL solicits legislative proposals.

  2. July 28, 2025

    Deadline to submit legislative proposals to DHHL.

  3. August 18, 2025

    DHHL submits draft legislative proposals to the Hawaiian Homes Commission.

  4. September 15, 2025

    HHC approves legislative proposals to move forward for consideration for the Governor’s Administrative Package.

Act 279

Act 279, SLH 2022, appropriates $600 million in general funds to provide a multi­-pronged approach to reduce the Department of Hawaiian Home Lands Waiting List. The $600 million will address the needs of beneficiaries on the waitlist and those still waiting to get on the land.
